Litigation

A lawsuit, or a controversy before a court, is referred to as litigation. If the two parties can not settle their dispute through mutual agreement, it is sometimes necessary to bring the issue before a judge or jury in a courtroom to render a decision. Litigation is one way for individuals or businesses to resolve a dispute.  In every case, there is a plaintiff (who brings the suit) and a defendant (one who is sued).

Other methods of dispute resolution are arbitration or mediation.  Arbitration is the hearing and determination of a dispute by an impartial third party.  Both parties agree to formally accept the decision of the or arbitrator at the conclusion of the process.  Mediation is a type a type of structured meeting with the parties and an independent third party who works to help them fashion a resolution that is agreeable by all parties involved.
